A magistrate in Moscow has imposed a so-called revolving fine of 115 million rubles to Zoom video service for non-fulfillment of obligations to organize the activities of a foreign person on the Internet in the Russian Federation, an Interfax correspondent reported.

"To appoint Zoom Video Communications Inc. punishment in the form of 115,068,103 rubles. 20 kopecks," Timur Vakhrameev, Justice of the peace of the judicial precinct No. 422 of the Tagansky district of Moscow, announced the ruling.

Zoom was found guilty of non-fulfillment of obligations stipulated by the legislation on the activities of foreign persons on the Internet in the territory of the Russian Federation (Part 2 of Article 13.49 of the Administrative Code of the Russian Federation).

According to the case materials announced in court, Zoom was imputed to work on the territory of the Russian Federation without creating a branch or representative office and ensuring their functioning. As noted in the protocol drawn up by Roskomnadzor in September 2023, the number of daily Zoom users in the territory of the Russian Federation from the beginning of the year to August is about 500 thousand people, the service operates in Russia in Russian. The company processes personal data of Russians and received funds from Russian individuals and legal entities.

Representatives and defenders of Zoom did not appear in court.

The service became the first foreign company to be held liable under this rule.

The penalty for such a violation for legal entities provides for a fine from 1/15 to 1/10 of the total amount of revenue received from the sale of all goods (works, services) for the calendar year preceding the year in which the administrative offense was detected, but not less than 6 million rubles.

According to the Federal Tax Service data obtained by the court, Zoom's revenue from the sale of all goods and services in 2022 amounted to more than 1.15 billion rubles. The company, by the decision of the judge, was sentenced to a fine of 1/10 of its size.

Earlier, in 2022 and 2023, Zoom was fined 1 million and 15 million rubles, respectively, for non-compliance and repeated non-compliance with the requirements for localization of personal data of Russian citizens in Russia (Parts 8, 9 of Article 13.11 of the Administrative Code of the Russian Federation).
